District school buildings and facilities are publicly funded for the primary purpose of educating students. Consistent with Idaho law, use of District facilities is not open for unrestricted public access, but may be permitted under conditions established by the Board. b. District school buildings and athletic fields may be made available to responsible individuals or organizations for education, civic, cultural, and other community uses consistent with the public interest, when such use does not interfere with the educational program or other school-sponsored activities. 2. Priority of Use a. Use of District facilities shall be prioritized as follows: i. School-sponsored activities, ii. Student organizations and activities, iii. Community volunteer and nonprofit groups, iv. Commercial and private users, b. Use of school facilities for the educational program or other school -sponsored activities shall take precedence over all other requests for use. 3. Approval and Denial of Facility Use a. Facility use requests shall be reviewed and approved at the building level by the principal or designee. i. Approval is limited to the specific facility areas identified in the facility use agreement. Access to any area not specifically approved is not permitted. ii. Instructional/classroom spaces are not available for rental (including, but not limited to, choir rooms, band rooms, classrooms, storage rooms, and other program-specific spaces) except by written exception approved by the principal or designee with conditions necessary to protect instructional readiness, school operations, and District property. iii. The District may limit rentals to purpose-designed common areas (e.g., auditorium, gymnasium, cafeteria, multipurpose room, or other approved spaces) and deny requests for additional “add-on” spaces. iv. The District reserves the right to approve or deny any request for use of its facilities based on the best interests of the District and its educational mission including maintaining a safe and appropriate school environment. Would materially interfere with or disrupt school operations or activities; ii. Presents a risk to the safety or security of students, staff, or property; iii. Is inconsistent with the intended use of school facilities or the District’s educational purpose, including requests for access to instructional/classroom spaces that are not available for rental except by written exception approved by the principal or designee; or iv. Violates District policies or applicable laws, including nondiscrimination requirements. 4. General Conditions of Use a. Use of the District’s facilities by non-school groups shall only occur at times when school is not in session and will not negatively impact academic or extracurricular programs. b. Persons on school premises must abide by the District’s policies and rules of conduct at all times. c. All activities must be appropriate for a school setting and comply with applicable laws. d. The District reserves the right to deny or revoke facility use when such use conflicts with District priorities, is deemed inappropriate or unsafe, or when users fail to comply with District policies or procedures. 5. Third-Party Use and Responsibility a. When District facilities are used by non-school organizations, those organizations operate independently of the District. The District does not sponsor, supervise, or manage the internal operations of third-party users, including participation decisions, vendor selection, or event management. b. The District is not responsible for mediating disputes between individuals, vendors, or participants involved in such activities. Responsibility for those matters rests with the organization renting the facility. c. All use of District facilities must comply with applicable laws, including nondiscrimination requirements, and District policies. If the District becomes aware of conduct that may violate law or District policy, including but not limited to unlawful discrimination, safety concerns, or misuse of District property, the District may review the use and take appropriate action, including modification or termination of the facility use agreement. The Board authorizes the establishment of fees to recover costs associated with facility use, including utilities, staffing, and maintenance. Reduced or waived fees may be provided for qualifying nonprofit or volunteer community groups. b. All fees shall be approved by the Board of Trustees and established in accordance with District policy governing fee approval. c. Fees shall be defined in the District’s fee schedule. 7. Delegation of Authority a. The Board directs the Superintendent or designee to develop and implement administrative procedures to govern the use of District facilities, including scheduling, approval, supervision, insurance requirements, and recommended fee structures. b. Facility use shall be administered in accordance with Procedure 9610P1 – Facility Rental Procedures. 8. Forms and Agreements a. Prior to using any of the District’s facilities, individuals or groups are required to complete all applicable forms and agreements as outlined in Procedure 9610P1 – Facility Rental Procedures, including but not limited to: i. Facilities Use Application /Agreement Form #9610F1 ii. Waiver of Liability and Indemnity Agreement Form #9610F2 iii. Waiver and Release of Liability and Assumption of Risk Form #9610F4 9.
