DUAL ENROLLMENT
1. Dual Enrollment Authorized
a. The parent or legal guardian of a student of school age who is enrolled in a
nonpublic school or public charter school and who resides within the District
may request that the student participate in District courses, programs, or
activities through dual enrollment in accordance with Idaho Code § 33-203.
b. Participation is subject to District eligibility requirements, scheduling, and
program capacity.
c. Dual enrollment is part-time participation and does not establish full-time
enrollment in the District.
2. Admission
a. The parent or legal guardian of any nonpublic or charter school student
wishing to enroll their child in any academic course or nonacademic activity of
the District must register the student in accordance with District enrollment
policy and procedures. These registration requirements apply even when a
student is requesting dual enrollment status only for participation in a
nonacademic activity (including interscholastic athletics). The parent or
guardian may be required to provide the following information to the extent
necessary to determine eligibility, placement, or participation:
i. Birth certificate;
ii. Evidence of residency within the District, as outlined in Board Policy
3006 - Proof of Residency;
iii. Immunization records or an appropriate waiver as required by law, as
outlined in Board Policy 3004 - Immunization Requirements;
iv. Student records from previously attended schools, if available, or any
other records necessary to determine academic placement or
eligibility; and
v. Necessary contact information for the parents or legal guardians of the
student.
b. Except in unusual or extenuating circumstances, a dually enrolled student
may only enroll in courses or programs appropriate for the student’s grade
level as determined by the school principal or designee.
c. Participation in District courses or activities through dual enrollment is subject
to scheduling availability and program capacity.

d. All necessary registration and enrollment requirements must be completed
before a dually enrolled student participates in a course, program, or activity.
3. Participation Requirements
a. Participation in Academic Courses
i. Eligibility. A nonpublic or charter school student shall be subject to the
same prerequisites and eligibility standards required of students who
are enrolled full-time in the school.
ii. Assessment Administration. The District may administer assessments
to determine whether a student has met prerequisite or equivalent
academic requirements for participation in a course or program.
iii. Scheduling and Program Capacities. Participation in academic courses
is subject to scheduling availability, program capacity, and approval of
the building administrator or designee.
iv. Elementary Instruction Requests. If a dually enrolled student wishes to
attend instruction in a particular subject area in a class or grade where
the curriculum is merged or integrated, the request must be made in
writing and must identify the specific subject area the student seeks to
attend (e.g., art instruction in a third-grade class). The teacher and
principal/designee will, upon request, provide available scheduling
information. It is the responsibility of the parent or legal guardian to
contact the school and determine when the identified subject area will
be provided. When subject matter is integrated into a mixed
curriculum, the District is not required to alter the presentation of the
curriculum to accommodate a dually enrolled student’s request.
b. Participation in Nonacademic Activities
The following rules apply for a nonpublic or charter school student to be
eligible to participate in nonacademic school activities (i.e., extracurricular
activities) for which traditional public school students must demonstrate
academic proficiency or eligibility:
i. IHSAA compliance. Participation in interscholastic athletics shall
comply with all applicable Idaho High School Activities Association
(IHSAA) rules.
ii. Attendance boundaries. A dually enrolled student must reside within
the attendance boundaries of the school for which the student seeks to
participate in nonacademic activities.

iii. Same eligibility standards. Eligibility standards must be met the
same as other regular full-time students.
iv. No restoration of eligibility by switching status. A student who
becomes academically ineligible to participate in nonacademic school
activities while enrolled in a public school may not regain eligibility by
transferring to a nonpublic school or public charter school for the
remainder of that school year and the following school year.
v. Demonstration of academic eligibility. Academic proficiency must
be demonstrated through one of the following options:
1. Nationally normed test. Documentation that the student has
achieved a minimum composite, core, or survey test score within
the average or higher-than-average range as established by the
test service utilized on a nationally normed test. The minimum
qualifying score on a nationally normed test is the fifth stanine for
the battery total score.
2. State-recognized assessment. A State Board of Education
recognized achievement test.
3. Portfolio/alternate mechanism. A portfolio or other mechanism
agreed upon by the District and the student’s primary education
provider.
vi. Testing cost and validity window. Parents or legal guardians are
responsible for obtaining any third-party testing at their expense.
Demonstrated academic proficiency will be used to determine eligibility
for the current and next following school years, not to exceed twelve
(12) months from the date test results are released.
vii. Testing opportunity. Nonpublic or charter school students shall be
provided the opportunity to take state tests or other standardized tests
administered to regularly enrolled public school students when such
tests are used to determine eligibility. Requests to participate in
District-administered testing must be pre-arranged with the building
principal/designee.
viii. Activity-day attendance. Attendance requirements on the date of an
activity will be the same for dually enrolled students as for traditional
public school students.
1. Attendance assurance from primary provider. If a dually enrolled
student is not scheduled to attend academic courses in the District
on activity days, the student’s primary education provider shall

provide assurance to the District that the student has met the
attendance requirements in the nonpublic or charter school
academic setting.
4. Fees for Dual Enrollment
a. If space is available in an existing program or activity, the
Superintendent/designee will only charge the dually enrolled student those
fees that are required of traditional public school students.
b. Dually enrolled students may be required to pay the same optional fees
charged to full-time students for optional materials, supplies, equipment,
uniforms, travel, meals, or other optional costs that are directly related to the
specific course, program, activity, or trip in which the student is enrolled.
5. Enrollment Priority and Capacity Limits
a. Maximum enrollment. A class or program is considered to have reached its
maximum enrollment when the number of students meets or exceeds the
overload class size limits identified in Exhibit E1, Class and Program
Enrollment Limits in Board Policy 3010 - Open Enrollment.
b. Specialized and high-demand programs. Enrollment in specialized or high-
demand programs, including advanced courses, performing arts programs, or
career technical education programs, is subject to program capacity,
prerequisite requirements, and scheduling availability, and dual enrollment
does not guarantee admission to such programs.
c. Priority window. Whenever enrollment in a class or program meets or
exceeds those class size limits, priority for enrollment shall be given to
students who are enrolled full-time in the school within the first two weeks of
each grading period.
d. No removal after priority window. After the first two weeks of the grading
period, a dually enrolled student may not be unenrolled to provide space for a
full-time student during that grading period.
e. First-come, first-served. If a number of nonpublic or charter school students
request admission into the same class, they will be accepted on a first-come
basis.
f. Students with disabilities. Students with disabilities residing in the District
who are attending charter, private, or home schools will be accepted in
accordance with state and federal statutes.

6. Student Presence on Campus
a. Permitted presence. Dually enrolled students are permitted on District
property only during the time necessary to participate in the specific course,
program, or activity in which they are enrolled unless otherwise authorized by
the building administrator.
b. Supervision limits. The District is not responsible for supervision of dually
enrolled students outside of the time the student is participating in the District
course, program, or activity. Students must leave campus promptly following
the completion of the class, program, or activity unless authorized to remain
by the building administrator.
7. Transportation
a. Authorized rider. A student who is dually enrolled may be considered an
authorized rider only in accordance with existing District transportation
policies and procedures.
b. No guarantee; no route changes. Transportation is not guaranteed and will
not be modified to accommodate dual enrollment schedules, partial -day
attendance, or participation in specific courses or activities.
c. No additional costs or equipment. As a rule, the District will not provide
transportation for dual enrollment if providing transportation would require
additional bus stops, route deviations, or additional equipment.
8. Participation in Field Trips and Activity Trips (including overnight
travel)
a. Direct component/required. A dually enrolled student may participate in a
school-sponsored field trip, activity trip, or overnight trip only when the trip is
directly connected to, and is a required component of, the specific District
course, program, or activity for which the student is dually enrolled.
b. Trip limitations. Dual enrollment does not create eligibility to participate in
trips or events that are not directly connected to the student’s specific dual
enrollment course, program, or activity, including trips that are primarily
connected to full-time enrollment status, grade-level cohorts, or the
graduating class (e.g., a “senior trip”).
c. Supervision window. For dually enrolled students, the District’s supervision
and responsibility is limited to the timeframe in which the student is
participating in the specific dual enrollment course, program, or activity,
including travel time when the trip is an official component of that course,
program, or activity and District supervision is provided.

d. Same requirements. A dually enrolled student participating in an approved
trip must meet the same participation prerequisites, conduct standards,
required forms, and deadlines that apply to full-time students participating in
the same trip.
e. Trip transportation. Transportation for school-sponsored extracurricular and
co-curricular activity trips will be handled in accordance with District policy.
Students will be required to ride District transportation to and from scheduled
events unless other arrangements are approved by the building
administrator/designee.
f. Administrative discretion. The building principal/designee may deny or
revoke participation in a trip when the student is not eligible, required forms
are not completed, supervision requirements cannot be met, or the trip is not
directly connected to the student’s approved dual enrollment course,
program, or activity.
9. School Rules, Regulations and Policies
a. Dually enrolled students will be subject to all District policies, regulations, and
school rules when they are on any school premises or at any school-
sponsored activity, regardless of location.
b. Such policies, regulations, and rules will include but not be limited to, those
relating to attendance, grades, prerequisites, classroom conduct, and
discipline.
c. A principal/designee may deny or revoke a dually enrolled student’s
participation in a course, program, or activity for just cause, consistent with
District policies, procedures, and school rules.
10. Average Daily Attendance
a. Dually enrolled students shall be included in the District’s Average Daily
Attendance reporting only to the extent of the student’s participation in District
programs, in accordance with state funding requirements.
11. Graduation
a. Dual enrollment provides access to specific District programs or activities and
does not establish full-time enrollment in Bonneville Joint School District No.
93.
b. Students who are dually enrolled are not eligible for a District diploma or
participation in the District’s commencement ceremony.

c. Eligibility for a District diploma is governed by Board Policy 2700 - High
School Graduation Requirements.
12. Students with Disabilities
a. IDEA/Section 504/ADA. Students with disabilities who participate in District
programs or activities through dual enrollment are subject to applicable
requirements of the Individuals with Disabilities Education Act (IDEA), the
Americans with Disabilities Act (ADA), and Section 504 of the Rehabilitation
Act of 1973 (Section 504).
b. Section 504. If a dually enrolled student is found eligible for a Section 504
Plan, the District’s process to develop and implement a Section 504 Plan
shall be followed.
c. Evaluation and Child Find.
i. Any evaluation for special education eligibility requested by a parent or
legal guardian shall be conducted in accordance with applicable
federal and state law and District procedures.
ii. Nothing in this policy limits the District’s obligations under the IDEA to
identify, locate, and evaluate children with disabilities residing within
the District in accordance with federal and state Child Find
requirements.
d. FAPE. Dual enrollment does not make the District responsible to provide a
full special education program (FAPE) to a student who is not fully enrolled in
the District. Any accommodations or supports provided by the District are
limited to the specific District class, program, or activity in which the student is
dually enrolled. Dual enrollment may not be used solely for the purpose of
obtaining special education or related services from the District.
i. Private/home school students. If a student is primarily enrolled in a
private school or home school, the student does not have an individual
right to receive all special education and related services the student
would receive if the student were enrolled full-time in the District. The
student may receive accommodations needed to access the specific
District class, program, or activity in which the student is dually
enrolled (including Section 504 accommodations when appropriate).
ii. Charter school students. If a student is enrolled in a public charter
school, the charter school remains responsible for the student’s special
education program. The District may provide accommodations needed
for the specific District class, program, or activity in which the student
is dually enrolled, but the District does not become the student’s
primary special education provider.

e. Equal access to general education. Students who are dually enrolled and
who are eligible for special education or Section 504 accommodations shall
be allowed to enroll in general education courses or programs under the
same criteria and conditions as students without disabilities.
i. Accommodations in enrolled programs. Students who are dually
enrolled may receive accommodations necessary for participation in
the general education courses or programs in which they are enrolled.
13. DEFINITIONS:
a. Dual Enrollment. A student residing within the boundaries of the District who
is legitimately enrolled in a nonpublic school (including a private, parochial, or
home school) or a public charter school, and who has not graduated from
high school, and who is also enrolled part-time in the District for one or more
specific District courses, programs, or activities under this policy.
b. Dually Enrolled Student. A student who is legitimately enrolled in a
nonpublic school (including a private, parochial, or home school) or a public
charter school, and who is also enrolled part-time in the District for one or
more specific District courses, programs, or activities under this policy, and
who has not graduated from high school.
c. Nonpublic Student. A student who is not enrolled in a public school and who
receives educational instruction in a private school, parochial school, or home
school program, and who has not graduated from high school.
d. On any school premises or at any school-sponsored activity, regardless
of location. Includes, but is not limited to, buildings, facilities, and grounds on
the school campus; school buses; school parking areas; and the location of
any school-sponsored activity. This includes instances in which conduct
occurs off school premises but impacts a school-related activity.
e. Primary Education Provider. The person or entity providing the majority of
the student’s educational instruction outside the District’s traditional public
school programs or activities.
f. Program and Activity. Any course of study or any interscholastic activity
recognized or sanctioned by the Idaho High School Activities Association
(IHSAA), or any school-sponsored co-curricular or extracurricular activity that
is connected to a District course or program. For purposes of dual enrollment,
“Program and Activity” includes school-sponsored trips (including field trips
and overnight travel) only when the trip is directly connected to, and is a
required component of, the specific District course, program, or activity in
which the student is dually enrolled.
