III.ItemsforDiscussion A.Superintendent'sGoals TheBoarddiscussedrentalfeesforDistrictfacilities.ThediscussionturnedtotheBelnap’sbasketballleague.About 27yearsagothey beganthe leagueandwerechallengedtokeepitgoing.They feeltheyarefulfillingtheirpartofthebargain.Theypaythesonstodothereferring.Itis nota financialpieceofwhattheydo buttheyaremakingmoney.Thequestionwasasked,“Arewe losing money?TheBoardwanted toknowwhy we are tryingtomakemoneywith chargingfees.Thereneedstobeadailyratethatiscapedatsomethingthatisfair and tied tothecostofusingthefacility. We don’twanttolosemoney.Weneedto keepitrevenueneutral.We needtomake surethatwe treat allcases thesame.Weshouldn’tdiscriminate. Wedon’twantto trytofixoneproblemand then hurtsomeoneelse.Wecouldastheindividualsto payadepositforcleanup.We wantgoodthings goingoninourschools.Superintendenttalkedabouttheprogramcalled Coaching Boysto Menprogram thatwillbeimplementedinthehighschools to helpstopbullying. Dr.ShackettdiscussedtheEightCharacteristicsofEffectiveSchoolBoardsandaskedtheBoardtoreviewthedocument.Hethen passedoutcopiesof theBoard’sGoalsandPotentialGoalsfromlastyearandthenadocumentshowing2012 -13PotentialGoalsfromChuckandMarjeanaswellasfrom theDirectorsandcoordinators. B.GoalSetting -WhatdoestheBoardwanttoachieve? Studentachievementisapriority fortheBoard.TheSuperintendent’s evaluationwillbeconnectedto studentachievement.Thequestionwas asked what theBoard wants toseeaccomplished that is tiedto studentachievement goals.JasonHancockandRyanKerbyhave astudent achievementpieceforadministrators thathopefullycanbeused.TheBoardwilldecidewhatwillbeconnectedtothe Superintendent’s contact. EvaluationoftheSuperintendent WhatistheBoard’sroleforevaluatingthesuperintendentwithregardtothenewlegislation?TheStateisonlyworkingonprincipals’evaluation rubric.Itisprettyalmostcomplete.Thereisnosuperintendentformatavailableatthistime. Dr.ShackettaskedtheBoardwhattheywanttoseeaccomplishedthatis tiedtostudentacademicgoals.Takeanaverageofbuilding achievementandusetheformulatoevaluateDistrictleveladministrationinthesameway.Attendance,graduationrate,andIRIandISAT performanceandgrowthshouldbeused inconjunctionwith Chuck’sform wheretheyindicatewhattheywanthimtostartdoing,continue doing, andstopdoing. Thequestionwasaskedhow theBoard wouldhaveparentsevaluateDistrict level administration.Howwelltheparentsaretreatedshouldbeone criterion.Wecouldpiggy-backoffthe principal’s evaluation. Studentsafety isanotherconcern.Thereisstillalotofbullyingisgoingon intheschools.There needs to be mutualrespect foreveryone. Coaching BoystoMen isa good step tohelpwiththis.Principalsneedtohelpwithaccountability tomakesurebullyingisaddressed.TheDistrict leveladministrationneeds toeducate the principals.Theyneedtostickupfor their students.TheDistrictneedsto holdstudentsandadultstoa high levelofaccountability.Disrespectandbullyingwillnotbetolerated. GoalsandexpectationsforindividualBoardmembers Mrs.Winchester and Mrs.Horman willvolunteertorideonthebusesperiodically. Mrs.Winchester willattendmoreschoolactivitiesandvisitmoreschools. Mr.Hunt willcontinueworkingwithSpecialEducation GoalsandexpectationsforSchools Non-negotiables Mrs.McConnellaskedtheBoardtodelineatethreeorfournon-negotiablessotheadministrationcanfocusonthesewithprincipalsas they moveforwardwiththePLCprocess attheirindividualschools. 1.Increase StudentAchievement 2.ShowRespect toEveryoneinthe SchoolCommunity.Weneedtoteachtheexpectations.Wecaneasilyquantifypoortreatment. Thereneedstobeafocusonbus drivers. 3.Welcome andInvolveParentsinthe Schools.Parentsneedto feellike theyare apartner withtheteachersintheirchild’s education.Parents needtofeelvaluedwhentheycometoschool. C.OptionsforFutureGrowth Dr.Shackettdiscussedthe numberofstudents currently enrolled.Thereare 652seniors and 947kindergarteners.Third graders (840)will enter the middleandhighschoolsin thenextthreetofour years.Soin2014-15wewillneedtodosomething.HediscussedtheIntermountainDemographics studyandtheprojectedusecharts. Manystudentswillopttofinishhighschoolearlyandtakeadvantageofcollegedualenrollmentduringtheirsenioryear.Thesecouldbe concurrent classes attheuniversitiesorthey couldbeonline classes.Thehighschoolswilluse the IENclassroomthisnextyear. Therearecurrently 50 -70fulltime studentsenrolled atBTCHthisyear and 20 -30halftime students.In three years,theenrollmentisprojectedto double.Wecurrentlyoffer Auto body,welding,and autotech.Asweaddprograms,wewilladd students. Webudgetedfor300newstudents thisyear.Ifwemovetospecialty highschools,students will berequired toparticipateinextracurricular activities at theirhomeschool.If wehave aschoolwithinaschool,thosenumberswillcount towardIHSAAranking. Wewillhaveboundaryhearingsthisyear.Thereisaneedtopurchasepropertyinthesouthend.Hillcrestmaybethecenterschoolandanewhigh schoolmightbebuiltmoretoward thesouthoftheDistrictsincethatiswherethegrowthseemstobehappening. TheBoardwantedtoknowwhatpropertywecurrentlyownintheDistrict.Mrs.Messick willask Roger Hill sendanemailregardinglandthathasbeen purchased includingthesize,location,andpossibleuseforeach. TheBoarddiscussedwhentheDistrictwouldhaveextrabondingcapacity.Dr.Shackettsuggestedthatwe willneed toconsiderbuilding afull comprehensive highschoolatthattime.Mrs.WinchesterandMrs.Horman suggestedspecialtyhighschoolsasanalternativetoacomprehensivehigh school. D.FacilitiesPlanningCommitteeintheFuture Mrs.Hormansuggestedthatweadoptthe District 91approach.Get communityleaders involvedandtake themtosee differenttypesofhighschools. District 91 wenttothemwithaplan.Theydidn’trelyonthe community tocomeupwithaplan.OurfacilitiesPlanning Committeewantedafull comprehensivehighschool.However,theydidn’t havetheopportunityto seeanyofthe specialty highschools.Weneedtodecidewhatwewanttodo, thengosellittothecommunity.Thecommunityisnotnecessarilyeducatedabouttheotheroptionsthatareavailable.Maybe aschoolcommittee shouldlookatoptionsthenpresentthemtothecommunityleaders. Untilweknowwheretheeconomyisgoing,wedon’twanttobuilda bighighschool.Becausewedon’tknowwhatthefullimpact ofthecurrent economy willbe.Weneedto utilize our existingspacemoreefficiently. Dr.Shackett will puttogetheranexecutivecommitteetofigureout aplan thenpresent it tothecommunity.Mrs.Winchester and Mr.Hunt willserveon theexecutivecommitteefromtheBoard.Dr.Shackett willappoint Districtstaff andmaybeinvolvethe mayors(Ammon,Iona,Ucon,and IdahoFalls)to getthe “drawing”made.Then wewill askwhatcolor thepatrons wanttoaddtoit.Weneedtocommunicatetheprosandconsofotherconceptsso theycanmakegoodchoices.Eventhoughtheyunderstandtheoptions,they seemtocomebackto wanting anewbuilding.It usually comesdown to howtheplanbenefits meandmyfamily. Mrs.Winchester hasbeenresearchingspecialtyhighschoolsallsummer.InNewYorktheyarepartofNewYorkpublicschoolssystem.Theyarenot charters.She suggestedthatweopen a SpecialtyFineArtsHighSchool andaddmath and sciencewingsatthetwohighschools and makethem specialtySTEM schoolswithintheschool.WealreadyoffertheTechnicalCareersHighSchoolandtheOnlineHighSchool.IEN isbeingusedasan optiontoreachbothhighschoolsnow.Then everyonehasachoice and we offer completeopenenrollment.Itwassuggestedthatwe onlyneed outsidewalls forabuilding and then adjust theinside fortechnology anddeliveryofthecurriculumasneeded. It wouldbehelpfultoreinstatethefacilitiesplanningcommittee buthave anexecutivecommitteetogetanoverview priortogoingtothe committee. E.NSBAConferenceAttendance No onewantstoparticipateintheconference thisyear. F.PatronInvolvement Theschoolsneedtocreateanenvironmentofopenness andafeelingthatparentsarewelcome.Teachers sometimesarenotperceivedas helpful. Duringnonevents parentssometimes feelthattheyarean imposition andteachers and/oradministrators only giveear service.Thechairmanis hearing concernregarding teachersmorethanadministrators.Dr.Shackett askedfor specificschoolsandpeople sohecanaddresstheproblems.Mr.Hunt suggestedthat sometimesthereisaproblem withthetransitiontomiddleschooland/or highschool andtheparent’sexpectationsofthefacultyand staffatthoseschools.Itisintimidatingformostparentstogetintothemiddleschoolsandhighschools.Weneedto figure out howtoengagethe Hispaniccommunitymore.We needtotranslate Districtmaterials.Thiscouldbeagreatseniorproject. WeshouldcreateaParent’sGuidetoComingto Schoolmaybe patternedafterthepatient’srightsdocumentsatthehospitals -ParentRights –Mrs. Messick willworkoncreatingthisdocument. G.BoardTraining Plan –Thisitemwastableduntilwehavenewboardmembers. 1.Whoshouldpresent?(ISBA,LegalCounsel,Others) 2.Whattopicsshouldbecovered? 3.Howoftenandwhen(monthly,worksessions,tenminutesegmentsatregularsessions,specialmeetings,etc.) H.LegalIssues -DougNelson 2:00p.m. 1.EthicsandConflictofInterestIssuesandParticipationontheBoard Mr.Nelsondiscussedprivacyandschoolcounselorethicalissues.These arestandardsthatareinplace and nationallyrecognizedputnot statutorilyrequired.Studentdisciplinaryissuesare confidentialinformation andthereare prohibitionsagainstsharingthisinformation.School counselorshaveethicalandlegaldutiespluscounselorsduties.They can’tkeepeverythingcompletelyconfidential.Theyneedtofollowthe FERPAstatute which prohibits disclosureof personal information.HowdowedealwithFERPAandtechnology?We willusepasswordsto allowaccessto studentinformationontheinternet. Therearethreesources ofinformationwhenyouhaveanethicalquestion:The BriberyandCorruptInfluenceAct;The EthicsinGovernment Act;and TheProhibition Against Contracts With Officers Act.TheBoardhas thepower andauthoritytomakepoliciestoregulate themselves. Mr.NelsondiscussedBoardPolicy #1600 CodeofConduct and #1610 ConflictofInterest.Hepresentedacopyofa ModelCodeofConduct andsuggestedthattheBoardcomparethatdocumentwiththeircurrentpolicy.Hestatedthatthe appearanceofbiascanbeaproblem.If someonecontactsBoardmembersregardinganissuetheyshouldtellthepersonthey appreciate the contact but if they shareinformation with theTrusteeit mayexclude the Board member frommaking a judgment lateron.Mr.NelsonaskediftheDistricthiressubstitute teachers throughtheBoard.Mrs.McConnellstatedthatwe haven’thiredsubsthroughthe Board becausetheycomeandgo.Howevera longterm substituteishiredthroughtheBoard. Any boardmembershouldrecuse themself from votingon the consentagenda whenanyrelativeisbeingconsideredforapositionoris involvedinacontractbeingapproved.ThisisaddressedinIdahoCode§33-507.Mr.Nelson suggestedthatthe safestposition is tonothirea spouse ofatrustee.Childrenandin-laws are okifyougothroughtheprocess.Declare a conflict,excuseyourself,and givewrittennotification. 2008AttorneyGeneral’swebsite alsoaddressesthisissue.TheBoardmust complywith generalstatutes,specificstatutes,andadopted policies.If they don’tcomply,it willmake any contract enteredintonulland void. Thereare certainsituationswherequestionsareraisedoncompatibilityofoffices.Canamayorserveinthelegislature?Common-lawdoctrine ofincompatibilitywoulditapply regarding holdingtwopublicofficesatthesametime suchasserving ontheboardofastatesponsored charterschool.Mr.Nelsonisnotawareofanystatutoryprohibitiontoservingbothinthelegislatureandontheschoolboard.IdahoCode Section 59-102mayapplyto Mrs.Horman.Therecould be asituationarisethatwouldrequirethelegislator torecuse themselffromvotingon alegislativeissue.A particularactioncouldcauseyou toviolate thisstatute.Youwillalso needtolookat the individualbodyrulesthatmay conflictwiththe otherbody’s rules.Becarefulthatyou don’ttosellopportunityforpecuniarygain.Considerifanything youaredoingwould showunfairfavoritismtotheentityIamaffiliatedwith.Mrs.Hormanaskedif attending ameeting byphonecountsasattendance.Youneedto publishin the noticeof the meetingthatamemberwillbe attendingby phone.You needtobeheardandbeabletohear. 2.Fees Mr.Nelsonaddressedfees.Hestatedthatfeesfortextbooksareunconstitutional.Feesassociatedwithregularcoursesofstudyare unconstitutional.Ifelectivecourseworkisrequiredforgraduation,thenfeesfortheseareunconstitutional.Feesshouldn’tbeassessedto makeupadifferenceinfunding.FeesestablishedthroughateacherorcoachforextracurricularactivitiesshouldbegovernedbytheBoard. Thereareprogramsthatallowthechildtoearnthemoneyforextracurricularfees.Thereisacross-overwhenaclassisgivenascreditfor varsitypreparation.Afeecannotbeapreconditionforparticipatingintheclass.Cheerleaderswhohavebeenselectedbycompetitiveprocess cannotbechargediftheytakeaclassforcredit.TheDistrictneedstomakealistofallfeesandthenhaveafeeadoptionbytheBoardona yearlybasis.Onlynewfeesorthosethatincreaseoverfivepercent(5%)oftheamountofthefeelastcollectedhavetogo throughthehearing process.Youcanpostthefeelist inthreedifferentplacesintheDistrict.Thequestionwasasked,“CanwemakemoneyasaDistrictthrough feescharged?”Anytaxingdistrictmayimposefeesrelatedtotheactualcostoftheservicebeingprovidedbutmaynotexceed(IdahoCode§ 63-1311).Non-studentparticipantscanbechargedfees. 3.Issues arising fromgroupsparticipatinginactivitiesandusingtheDistrictorSchoolnamewhennot authorized bytheBoard ShouldtravelrequestscometotheBoard?Itisbettertohaveanapprovalprocessandthenenforceit.Thenyouareinsured.TheBoard needstosetminimumstandardsandmakesuretheyaremet.Weprobably needtoseparate clubtravelfromDistrict sponsoredteamsand activities andlet the parentsknowthat clubsarenot sponsored.We don’twanttoapproveallnon-seasonactivities. 4.IssuesarisingfromgroupsusingDistrict facilitiesand liabilityIssues GroupsneedtoprovidetheDistrictwithproofofliabilityinsurancecoverage. TheBoardrequestedachangein financialreporting.Theywouldlikemorerelevantinformationmaybeinasummaryandanalysisformat.
